βœ… Your BTR & Certification Checklist

Use the checkboxes below to track your compliance and certification progress step by step!

1What Is a Business Tax Receipt (BTR)?

Understand the BTR Requirement

A Business Tax Receipt (BTR) — formerly called an Occupational License — is a mandatory annual permit issued by your county or city government that authorizes you to legally operate a business in their jurisdiction. It is governed by Chapter 205 of the Florida Statutes.

A BTR is required for every business type and size: LLCs, sole proprietors, corporations, home-based businesses, online businesses, service providers, and contractors. If you're doing business in Florida, you need one.

⚠️ Penalty Notice: Operating without a BTR is a misdemeanor in Florida. Penalties include a 25% tax surcharge plus up to a $250 fine if you remain non-compliant for 150+ days after notice. Do not skip this step.

2City vs. County — Do You Need One or Both?

Determine How Many BTRs You Need

πŸ“ The Core Rule: Florida law allows both a county government and a city/municipal government to each levy their own separate business tax. These are two different permits from two different agencies with two different fees. Whether you need one or both depends entirely on where your business address is physically located.

πŸ”΄ Both City + County Required

  • Business address is inside city or town limits (incorporated area)
  • Home-based business within an incorporated city
  • Contractors, service providers, mobile businesses operating in city boundaries
  • E-commerce/online businesses with a city address
  • Pursuing government contracts — Broward CBE/SBE programs require both
  • Operating in: Fort Lauderdale, Hollywood, Davie, Coral Springs, Pompano, Deerfield Beach, Miramar, Plantation, Sunrise, etc.

🟣 County Only

  • Business address is in an unincorporated county area — outside city limits
  • Home-based business in unincorporated county land
  • State-certified DBPR mobile vendors — generally just home county + home city
  • Not sure? Contact your county property appraiser to confirm whether your address is inside city limits
βœ… Simple Test: Ask yourself: Is my business address inside a city or town? Yes → need BOTH a city BTR and a county BTR. Outside city limits → county BTR only. When in doubt, contact your municipality first — some cities require their approval before the county will issue theirs.
πŸ”‘ Order of Operations When You Need Both:

In most Florida counties, apply for the city BTR first, then the county BTR. Broward County explicitly says: "Check with your city for any requirements before applying for a Broward County Business Tax Receipt." However, Flagler County reverses this — get county first. Always confirm with your specific city and county before starting.

πŸ›οΈ Government Contracting — Both Always Required: Broward County's CBE/SBE programs and the Micro-Grant pilot program all explicitly require both a valid Broward County BTR and a valid City BTR as eligibility criteria. If you are pursuing any local government contracts, you need both — period.

3How to Get Your Broward County BTR

Apply for Your Broward BTR — Step by Step

1
Check Your City First (If Inside City Limits) Contact your city's business licensing or zoning office first. They may require a zoning review or Certificate of Use before Broward County will issue your BTR. Find your city by searching "[City Name] FL business tax receipt."
2
Visit the Official Broward Tax Collector Website Go to browardtax.org/business-tax-receipt — official site of Tax Collector Abbey Ajayi's office. Rules, fees, important dates, back-tax details, and contact info are all here.
3
Gather Your Documents (See Section 5 Checklist) Have ready: EIN or SSN, registered business name matching SunBiz, business address, and any state professional license if your industry requires one.

4⚠️ The Start Date Trap — Read Before You Apply

πŸ—£οΈ Real Talk — From the Field

When you apply for a BTR, one of the questions asks when your business started operating. If you enter your actual founding year — say, 2020 or 2022 — the county automatically calculates back taxes for every year from that date to the present.

In Broward County, back taxes are charged up to 3 years plus the current year. Each back-year is also charged the full 25% late penalty plus a $25 tax collector fee per year. What should be a $16–$30 receipt can instantly become $200–$300+ just from the start date you enter.

If you enter a recent or current date as your start date, you are only charged for that current fiscal year — no back taxes.

πŸ”΄ Broward Back Tax Formula (Per Prior Year):

Annual BTR Fee + 25% late penalty + $25 tax collector fee = total per back-year. Lookback limit: 3 years + current year. Other counties may differ — always confirm with your local tax collector before applying.

πŸ’‘ This is not legal or financial advice. Consult your CPA or attorney about the best approach for your specific situation. But going in uninformed can cost you hundreds of dollars.
πŸ“… Timing Tip: Florida's BTR year runs October 1 through September 30. Some jurisdictions (e.g., City of Hollywood) only charge 50% of the annual fee if you apply on or after April 1 of the current fiscal year. Timing your first application can save money.

5BTR Application — Document Checklist

πŸ“‹ Gather Everything Below Before You Start

Missing documents will delay your application. Have all of these ready before you begin.

EIN (Employer Identification Number)

Free from the IRS — apply at irs.gov/ein. Sole proprietors may use SSN but EIN is strongly recommended. Also save your IRS EIN Confirmation Letter (CP-575) — you'll need it for certifications and bank accounts.

Registered Business Name (exact match required)

Must exactly match what's on file and showing ACTIVE status at sunbiz.org. If you use a trade name or DBA, that must also be filed with the Florida Division of Corporations.

Business Physical Address

Where the business operates — commercial or home. This determines city vs. county BTR requirement.

State Professional License (if your profession requires one)

Required for: contractors, real estate agents, insurance agents, physicians, pharmacists, CPAs, cosmetologists, food service, electricians, plumbers, and other DBPR-regulated professions. Get this before the BTR. Check at myfloridalicense.com.

City Zoning Approval or Certificate of Use (commercial locations)

Required by most cities for commercial spaces before the BTR is issued. Get from your city's Planning or Zoning department. Home-based businesses in most jurisdictions do not require a CU.

DBA / Fictitious Name Registration (if using a trade name)

If operating under any name other than your exact legal name or registered entity name, file first at sunbiz.org.

Payment Method

Credit/debit card online; cash, check, or card in person. Card payments may include a small processing fee.
